GENERAL DATA PROTECTION REGULATION (GDPR)

Laois County Council will obtain and process personal data in accordance with the fulfilment of its functions and its legal obligations. Laois County Council will only use and disclose personal data in ways, that are necessary for the Purpose(s) for which it is collected. Laois County Council is committed to protecting the privacy of personal data. The Council will, at all times comply with, the Data Protection Legislation(s) i.e. The Data Protection Acts of 1988 – 2018 and the General Data Protection Regulation”.

The Poor Relief (Ireland) Act 1838 – Local Government Reform Act 2014 provides the legal basis to collect and process information in relation to the collection of monies due to Laois County Council.

Transfer of Property

The Local Government Reform Act 2014, provides for a wide range of reforms to local authority functions, structures and funding, and includes a number of changes in respect of Commercial Rates.

New legal requirement on owners/ratepayers in relation to a transfer of property:

Section 32 of the Act places –

An obligation on property owners, or their agents, to notify the Local Authority where an interest in a rateable property is transferred and the person liable for rates changes.
The person transferring the property, either the owner or occupier, must discharge all rates for which he/she is liable at the date of transfer.

Failure to notify Laois County Council of a change in interest within 14 days of the transfer date, may result in a penalty for non-compliance in that, the owner becomes liable for an amount which is equivalent to the level of outstanding liabilities (up to a maximum of 2 years liability).

This obligation comes into effect on 1st July, 2014

Gheobhaidh agus próiseálfaidh Comhairle Chontae Laoise sonraí pearsanta de réir chomhlíonadh a feidhmeanna agus a hoibleagáidí dlíthiúla. Ní úsáidfidh agus ní nochtfaidh Comhairle Chontae Laoise sonraí pearsanta ach ar bhealaí, atá riachtanach don Chuspóir/do na Cuspóirí dá mbailítear iad. Tá Comhairle Chontae Laoise tiomanta do phríobháideacht sonraí pearsanta a chosaint. Comhlíonfaidh an Chomhairle, i gcónaí, an Reachtaíocht/na Reachtaíocht um Chosaint Sonraí i.e. na hAchtanna um Chosaint Sonraí 1988 – 2018 agus an Rialachán Ginearálta maidir le Cosaint Sonraí”.

Soláthraíonn an Poor Relief (Ireland) Act 1838 – An tAcht um Athchóiriú Rialtais Áitiúil 2014 an bunús dlí chun faisnéis a bhailiú agus a phróiseáil maidir le hairgead a bhailiú atá dlite do Chomhairle Chontae Laoise.

Aistriú Maoine

Foráiltear leis an Acht um Athchóiriú Rialtais Áitiúil 2014 do raon leathan athchóirithe ar fheidhmeanna, struchtúir agus maoiniú na n-údarás áitiúil, agus cuimsíonn sé roinnt athruithe maidir le Rátaí Tráchtála.

Ceanglas dlíthiúil nua ar úinéirí/íocóirí rátaí maidir le haistriú maoine:

Cuireann Alt 32 den Acht –

Dualgas ar úinéirí maoine, nó ar a ngníomhairí, fógra a thabhairt don Údarás Áitiúil sa chás go n-aistrítear leas i maoin inrátaithe agus go n-athraíonn an duine atá faoi dhliteanas rátaí.
Ní mór don duine atá ag aistriú na maoine, bíodh sé/sí ina úinéir nó ina áititheoir, na rátaí go léir a bhfuil sé/sí faoi dhliteanas ina leith ar dháta an aistrithe a urscaoileadh.

Mura gcuirtear athrú leasa in iúl do Chomhairle Chontae Laoise laistigh de 14 lá ó dháta an aistrithe, d’fhéadfadh pionós a bheith mar thoradh air mar gheall ar neamhchomhlíonadh sa mhéid sin, bíonn an t-úinéir faoi dhliteanas i leith méid atá comhionann le leibhéal na ndliteanas amuigh (suas le dliteanas 2 bhliain ar a mhéad).
