Tenancy succession may apply if:
- If a tenant dies and there is a joint tenant, the tenancy might automatically go to the surviving tenant(s).
- In case of a tenant's death, the tenancy usually goes to a family member who:
- is over 18,
- lived in the house and was assessed for rent for at least 18 months before the tenant's death.
- If multiple qualifying family members exist, they might get a joint tenancy.
Succession is not allowed:
- If the property is designated for older persons or special needs.
- Families might need to move to smaller housing if their current house is too large.
- If a house was adapted for a person with a disability who no longer lives there, the family might have to move to other housing.
- If a qualifying family member behaves antisocially, the Council can refuse tenancy succession.
