Tenancy Succession Support

Laois County Council may help someone living with a tenant in a Laois County Council house take over the tenancy if it ends.

Tenancy succession may apply if:

  • If a tenant dies and there is a joint tenant, the tenancy might automatically go to the surviving tenant(s). 
  • In case of a tenant's death, the tenancy usually goes to a family member who: 
    • is over 18, 
    • lived in the house and was assessed for rent for at least 18 months before the tenant's death. 
  • If multiple qualifying family members exist, they might get a joint tenancy. 

Succession is not allowed:

  •  If the property is designated for older persons or special needs. 
  • Families might need to move to smaller housing if their current house is too large. 
  • If a house was adapted for a person with a disability who no longer lives there, the family might have to move to other housing. 
  • If a qualifying family member behaves antisocially, the Council can refuse tenancy succession.
